Other Regulatory Processes

This page lists other important policy processes relevant to Klamath River water quality that Consortium member Tribes are either participating in or observing.

Incidental Take Permits for Coho Salmon
Coho Salmon are listed as threatened in northwestern California and southern Oregon under both the federal Endangered Species Act (ESA) and California Endangered Species Act (CESA). An Incidental Take Permit (ITP) is required by the ESA and CESA by any party planning to engage in any land or water use that might cause harm to listed species. Two different ITPs have been considered in the Klamath Basin. The first is for PacifiCorp's Klamath Hydroelectric Project, the second is for agricultural operations in the Shasta and Scott Valleys.

Statewide Clean Water Act Waiver for National Forests in California
The U.S. Department of Agriculture, Forest Service (USFS), in collaboration with the State and Regional Water Boards has developed a new Water Quality Management Handbook (WQMH) to address control of nonpoint source pollution generated by various activities on National Forest System lands in California. The State Water Board has developed a proposed statewide Waiver of waste discharge requirements and reports of waste discharge for the nonpoint source activities covered by the WQMH. Some Consortium member Tribes participated in a stakeholder group and submitted comments on the draft waiver and WQMH.
